Trucking Violations and the Courts
( Long Island and NYC )
The following is summary of the more common courts that handle trucking violations throughout Long Island, and the 5 Boroughs, and the nuances for each court.
Suffolk County
Most Suffolk County Trucking Violations will be returnable to the First District Court at 400 Carleton Avenue, Central Islip. East end tickets may be returnable to the Riverhead town Court, or the Southampton Town Court. A few Suffolk County Trucking Tickets will find there way to the Suffolk County Traffic Violations Bureau in Hauppauge.
For the most part, tickets returnable to Suffolk County District Court, (It is also the criminal court). Often these tickets are not accompanied with a supporting deposition. If the officer failed to provide a supporting deposition at the stop, one should be requested from the court. Often these tickets can be dismissed when the court/ officer fails to provide a supporting deposition when requested. There are time limits associated with filing of the request. The motion to dismiss requires a written legal motion to be considered.
Nassau County
Most trucking violations in Nassau County end up at the Nassau County First District Court at 99 Main Street, Hempstead. Other trucking tickets will be returnable to the various village and city courts in Nassau County. The First District court is also the Criminal Court. Despite what the tickets may say, tickets returnable to the Nassau County First District court will require a personal appearance by the defendant. If the tickets have been issued to a corporation, then an attorney representing the corporation will be required to appear. There is one prosecutor assigned from the Nassau County District Attorneys Office to prosecute the trucking violations. Our goal as an attorney on these cases is to get as many of these tickets dismissed as possible and to keep the fines as low as possible.
Glen Cove City Court
The City of Glen Cove gives out quite a few trucking tickets for a municipality of its size. The Trucking violations are prosecuted by a prosecutor from the City Attorneys Office. The judge in that court is very strict. The Glen Cove City Court is located at 13 Glen Street, Glen Cove NY 11542
Lynbrook Village Court
Lynbrook is another village that gives out quite a few trucking tickets in relation to its size. Lynbrook trucking tickets are returnable to the Lynbrook Village Court located at 1 Columbus Drive, Lynbrook NY 11563
Queens
Queens Trucking Tickets can go to either the Queens Criminal Court at 25-01 queens Blvd. Kew Gardens or to one of the Queens Traffic Violations Bureaus (TVB) depending on how the officer writes the tickets. Queens North Traffic Violations Bureau is located at 30-56 Whitestone Expressway, Queens while Queens South Traffic Violations Bureau is located at 168-35 Rockaway Blvd, Queens.
Often the same offense can be written either as a Vehicle and Traffic law violation (VTL) or as a Department of Transportation (DOT) violation. Department of Transportation tickets will usually end up at the Criminal court, while VTL violations may be returnable to either the Queens Traffic Violations Bureau or to the Queens Criminal Court. What is important to know is that like most courts in New York City and the 5 Boroughs, should you not respond to a trucking ticket, you may be automatically convicted, and the fines and consequences can be huge. Brooklyn
Brooklyn Trucking Tickets can go to either the Brooklyn Criminal Court ( New York City Criminal Court, Kings County) 120 Schemerhorn Street, Brooklyn, New York or to one of the Brooklyn Traffic Violations Bureaus (TVB) depending on how the officer writes the tickets. Brooklyn North Traffic Violations Bureau is located at 30 Rockwell Place, Brooklyn while Brooklyn south Traffic Violations Bureau is located at 2875 West 8th street, Brooklyn.
